2019 Doo the Right Thing Calendar Photo Contest Official Rules

1. Description:
The 2019 Doo the Right Thing Calendar Contest (the “Contest”) provides you with an opportunity to submit photographs of your dog(s) to be featured in the 2019 Doo the Right Thing Calendar. By participating in the Contest, you unconditionally accept and agree to comply with and abide by these Official Rules, the entry form, the Terms and Conditions of Use of the Website, and the decisions of the Regional Stormwater Management Program in partnership with the North Central Texas Council of Governments (the “Sponsor”), which shall be final and binding in all respects. 

2. Deadline:
Online pledge entries open on January 1, 2018. The submission deadline is 11:59 p.m. Central Time on June 30, 2018 (the “Contest Period”). See the Judging section of these Rules for more information on public voting.

3. Eligibility:
Open to residents of the North Central Texas region (see www.nctcog.org/regional_map.asp) who own or take care of the dogs for which they are submitting the Doo the Right Thing pledge (the “Entrant”). The Contest is void wherever restricted or prohibited by law.

A submission is the original photograph of the Entrant’s dog(s) in one of the file types specified on the pledge/photo submission form (the "Submission"). There may be only one (1) Submission per pledge/pet. If more than one (1) Submission per pledge/pet is received, the Sponsor will select one (1) for judging at its sole and absolute discretion. Photos that include people will automatically be disqualified.

The Submission must be the original work of the Entrant and must not infringe upon the copyrights, trademarks, rights of privacy, publicity, or other intellectual property or other rights of any person or entity. By submitting a Submission, Entrant warrants and represents that he/she consents to the submission and use and exhibition of the Submission in the manner set forth in these Official Rules and the Terms and Conditions of Use of the Website.

Sponsor reserves the right to disqualify any Submission for any reason, in its sole and absolute discretion. Any Contest Entry or photo that, in the sole opinion of Sponsor, is considered inappropriate or not suitable for publication under the Official Promotion Rules or Official Contest Rules may be disqualified.

4. How to Enter:

To be eligible for the full-page image for the month, photos must be at least 3000x2000 pixels and in landscape orientation.

Photos of lesser quality or in portrait orientation may be considered as supplemental images for the calendar.

First, complete the pledge and acknowledge that you have read the Official Rules and agree to the photo release agreement.

Next, create an original photograph of your dog(s) in an acceptable format (the Submission). Once you’ve created your Submission, submit your entry according to the onscreen instructions. A completed entry is a fully completed pledge and the Submission.

5. Additional Guidelines:
Incomplete entries, including those Submissions that do not meet the requirements specified in these rules, will not be eligible for judging. All requested information on the pledge must be completed to be eligible. Any Submission that is considered by the Sponsor in its sole and absolute discretion to be inappropriate will be disqualified.

Proof of submitting any Submission is not considered proof of delivery or receipt of such Submission. Furthermore, the Sponsor shall have no liability for any Submission that is lost, intercepted, or not received by the Sponsor.

Sponsor does not guarantee the posting of any Submission and any/all posting in the Contest image gallery or on any social media platforms for public judging is at Sponsor’s sole discretion. At any time during the Contest, even if the Submission is already posted for viewing or judging, or it has been announced as a Contest winner, if Sponsor determines that an Entry does not comply with any of the Official Rules, such Entry may be disqualified.

6. Judging:
In July 2018, the Regional Stormwater Management Program’s Public Education Task Force or its selected administrators at Sponsor’s sole discretion will evaluate Qualified Submissions received during the Contest Period and categorize the Submissions for public voting.

Qualified Submissions will be posted on the Contest Webpage (www.dfwstormwater.com/petwaste) after the deadline has passed.

The Sponsor will notify entrants with Qualified Submissions via email that the public voting period is open.

Public Voting. The public voting period will begin by August 2018, and will end approximately four weeks after the period begins. Limit: Each public voter may vote only once. The use of robotic or automatic devices for voting is prohibited. Votes generated by script, macro, or other automated means, or with the intent to impair the integrity of the voting process will be void and Sponsor reserves the right to nullify all such votes and to disqualify from voting the responsible individual. At the end of the public voting, the photos receiving the most votes in each Category will be selected as winners.

Ties. In the event of a tie, the tie will be decided by Regional Stormwater Management Program’s Public Education Task Force or its selected administrators at Sponsor’s sole discretion.

7. Notification:
Selected Entrants will be notified by email within one month of the final judgment.

8. Your Rights:
Thank you for helping to further our mission through your photography and pledge. You will retain all rights to any photograph you submit. By submitting your photograph, you grant the Sponsor the right to use the photograph on the Contest webpage and on platforms such as social media in order to promote the public voting portion of the Contest. (Note: This contest is in no way sponsored, endorsed, or administered by, or associated with Facebook, Twitter, or Instagram, and Entrants release Facebook, Twitter, and Instagram from any and all liability associated with the Contest.)

You only grant the Sponsor rights to your photograph as described below if it is selected to be included in the 2019 Doo the Right Thing Calendar. If your photograph is selected, you grant the Sponsor a royalty-free, nonexclusive right, in perpetuity, to:

  • Use the photograph on the Internet in support of our mission.
  • Provide your photograph to other individuals and organizations for non-commercial use.
  • Sponsor-related use in news stories, newsletters, reports, slide shows, displays, web pages, and similar publications/presentations.
  • Use, in connection with the Contest, your first name and initial letter of last name, city/town, and pet’s name in promotions and other publications.
  • Keep the files provided, and to archive the images on CD or in other electronic forms, so that your photos can be used to support our mission and be properly credited.

9. General Liability Release:
Entrants agree that the Sponsor shall not be responsible or liable for any losses, damages, or injuries of any kind resulting from the Contest or any Contest-related activity. Entrant agrees that the Sponsors are not responsible for any unauthorized use of Contest Entries or photos by third parties. Sponsor and the Promotion Parties assume no responsibility for any damage to an Entrant’s computer system which is occasioned by accessing the Website or participating in the Contest, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions, or network connections that are human or technical in nature.  Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, or stolen Submissions or notifications; or for lost, interrupted, inaccessible, or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone, or cable transmissions; or for any technical malfunctions, failures, difficulties, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. In the event Sponsor is prevented from continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, earthquake, explosion, labor dispute or strike, act of God or public enemy, or any federal, state, or local government law, order, or regulation, or other cause not reasonably within Sponsor’s control (each a "Force Majeure" event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Contest. If the Contest is terminated before the designated end date, Sponsor will (if possible) select the winners from all eligible, non-suspect Submissions received as of the date of the event giving rise to the termination. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
